Either a stuck float or bad float needle seat. Your carb probably could do with a good cleaning.

Thats what i was thinking of doing on my off day is it the same as a four stroke

pretty much, only simpler
the carb should be the same but no valves or cams to worry about
though there is a set of KIPS on there that could probably stand a good cleaning
before you tear into the carb though, stop down by your local hardware store and pick yourself of some 6X20 allenheads to replace the bowlscrews that are on there...I don't know why but for some reason the heads are made out of gingerbread
on more possibility is a leaking float, if there is fuel in there it wont float and close the fuel supply either

Once you pull the carb, the cap on the top unscrews and the slide/needle will pull right out. You don't have to disconnect your throttle cable at all.

Welcome, cleaning a two strokes carb is an easy job and there are no springs other that the one on the slide.search for mikuni carb setting or cleaning in YouTube for the correct procedure and you are ready to go. Congrats on your new bike.

There's a reason a discontinued line of bikes has such an active forum. Or as my buddy rbates so simply put it in the quote in my signature.

Give her a little love and she will reward you with some great fun.

if I kick mine over it will pour out gas too, but when I pick it back up and keep the bike upright it is fine
